Despite it being a legal requirement there are many people who regularly use our roads without having valid insurance. Should you be unfortunate enough to be involved in an accident with an uninsured driver and you have suffered injuries due to their negligence it may still be possible to pursue a claim for compensation.
Generally speaking most claims for compensation are pursued against the insurance company of the driver who is deemed responsible for the accident; however in circumstances where this isn’t an option a claim can be pursued against the Motor Insurers’ Bureau.
Not only can a claim be made against the Motor Insurers’ Bureau if the other driver is uninsured, but it is also possible in certain circumstances to pursue a claim if the other driver has failed to provide their details or failed to stop at the scene of the accident and remains untraced.
There are some quite significant differences in how claims against Uninsured and Untraced Drivers are made and it is important to seek expert advice from qualified Solicitors who have the required experience in dealing with these types of claims. Claims can be rejected is the proper procedure isn’t strictly followed.
If you involved in an accident with either an Uninsured or an Untraced Driver it is important that the accident is reported to the police as soon as possible. Failing to report that incident can result in the Motor Insurers’ Bureau rejecting the claim.
At NGA Solicitors we regularly pursue injury claims to the Motor Insurers’ Bureau on behalf of our clients based in Lancashire from our offices in Burnley and Colne but also represent clients nationwide. We pride ourselves on the flexible approach offered and we will always communicate with our clients in a method best suited to your needs and requirements.
