What happens next?

A member of our personal injury department will take full details of the accident and the personal injury and losses which are to be claimed. If it is more convenient then we can arrange for a member of our team to attend your home address or the scene of the accident.

What does it cost to pursue a claim?

It does not cost anything as we normally pursue claims for personal injury on a No Win No Fee basis.

What is a No Win No Fee?

This is otherwise known as a Conditional Fee Agreement (CFA). If your claim is successful then we can recover our fees in full from the insurance company that pays your compensation. If your claim is not successful then we agree to not charge for our costs incurred*. If court proceedings have been required then NGA can also arrange for an insurance policy to protect you from having to pay your opponents costs if you lose. The premium is payable by your opponent if the case succeeds and if unsuccessful then the insurance policy covers the cost of the premium.

*Provided that we receive your full co-operation during the claim.

Are all claims covered by a No Win No Fee Agreement?

Claims for criminal injury or applications to the Motors Insurance Bureau (if driver responsible was untraced or uninsured) are excluded.

What injuries and losses can I claim for?

A claim can be made for any injury that resulted from an accident that was not your fault and any subsequent losses can be recovered if your claim is successful. Our personal injury team is available to advise on individual circumstances.

Is there a time limit for pursuing a claim?

A claim must be made to a local county court within 3 years of the date of the accident
UNLESS

  • at the time of the accident the you were aged less than 18. In these circumstances the 3 year time limit does not start until the victim reaches 18 years of age.
  • if you were not immediately aware of the injuries sustained then the three year time limit does not start until the date of awareness.
  • your claim is for criminal injuries or your injuries are due to an untraced driver. In these circumstances the time limit is two years.
